Terms of Service

Pluto Family Calendar lets your household keep a shared family agenda and show it on a display at home, while you retain ownership of everything you add. We only get permission to store and display your content as needed to operate the service. We may suspend accounts that violate our rules. Pluto Family Calendar is provided as-is with no uptime guarantee, and we aren't liable for lost data or other damages related to your use of the service. Paid users can request a full refund within 30 days, no questions asked.

Welcome to Pluto Family Calendar. These Terms of Service (“Terms”) govern your use of the Pluto Family Calendar website, web application, and mobile application (collectively, the “Service”). By creating an account, signing in, or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. The Service

Pluto Family Calendar lets you set up a household, add family members and events, and pair a display so that today’s agenda can be shown at a glance.

Pluto Family Calendar is a planning and organizational tool only. It is not a substitute for your own judgment, and you are responsible for checking that the information you enter is correct.

2. Eligibility

You must be at least 13 years old to use Pluto Family Calendar. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian where required by law.

By using the Service, you represent that you meet these requirements.

3. Your Content

You retain ownership of the content you submit to Pluto Family Calendar, including your:

  • Household settings, family member profiles and events;
  • Profile details and uploaded photos; and
  • Other content you submit to the Service.

License to Pluto Family Calendar

You grant Pluto Family Calendar a non-exclusive, royalty-free, worldwide license to store, process, copy, and display your content only as reasonably necessary to operate and provide the Service, including showing your agenda on displays you have paired to your household.

This license ends when you delete the applicable content, except that copies may remain temporarily in backups and information may be retained as part of moderation or other records where reasonably necessary.

4. Paired Displays

A display you pair to your household shows your household’s agenda to anyone who can see the screen. You are responsible for deciding where a display is placed and for revoking a display you no longer control.

5. Usage Data and Service Data

Pluto Family Calendar owns data created by the Service about its operation and usage, including sign-in records and moderation records.

We do not claim ownership of your submitted content merely because we process it to provide the Service.

Our collection and use of personal information is described in ourPrivacy Policy.

6. Acceptable Use

You agree not to use Pluto Family Calendar to:

  • Violate any applicable law or regulation;
  • Upload, store, publish, or share illegal content;
  • Abuse, harass, threaten, defraud, or harm others;
  • Distribute malicious software or other harmful material;
  • Attempt to gain unauthorized access to the Service or another user’s account or data;
  • Interfere with or disrupt the Service;
  • Circumvent security, access controls, or usage restrictions; or
  • Use the Service to distribute content that Pluto Family Calendar reasonably determines to be morally or ethically inappropriate for the Service.

Pluto Family Calendar may suspend or ban accounts, remove or restrict content, or otherwise restrict access when we believe these Terms have been violated or when necessary to protect the Service or its users.

7. Accounts

You are responsible for maintaining the security of your account and for activity performed through your account.

You agree to provide accurate information when registering and to keep your account information reasonably current.

Pluto Family Calendar may suspend or terminate accounts that violate these Terms or that we reasonably believe create a risk to the Service, its users, or others.

8. Payments and Refunds

Some features of Pluto Family Calendar may require payment.

If you pay for a subscription or other paid offering, you may request afull refund within 30 days of your payment, no questions asked.

Refunds may be processed through the payment provider used for the applicable transaction.

9. Availability and Support

Pluto Family Calendar is provided on an “as is” and “as available” basis.

We do not guarantee that the Service will:

  • Be available at any particular time;
  • Be uninterrupted or error-free;
  • Remain available indefinitely;
  • Preserve your data indefinitely; or
  • Meet your particular requirements.

Pluto Family Calendar does not provide a guaranteed uptime commitment or a guaranteed level of customer support.

10. Intellectual Property

The Pluto Family Calendar software, Service, design, interfaces, features, “Pluto Family Calendar” name, logos, trademarks, and branding are owned by Pluto Family Calendar or its licensors and are protected by applicable intellectual-property laws.

Except for the rights expressly granted to you under these Terms, no rights to Pluto Family Calendar’s intellectual property are granted to you.

11. Disclaimer of Warranties

To the fullest extent permitted by law, Pluto Family Calendar is provided without warranties of any kind, express or implied.

We disclaim warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and that the Service will be secure, uninterrupted, or error-free.

We do not warrant that information available through the Service is accurate, complete, current, or suitable for your particular use.

12. Limitation of Liability

To the fullest extent permitted by law, Pluto Family Calendar and its owners, operators, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Service.

This includes, without limitation, damages or losses relating to lost data, lost profits, missed appointments, inaccurate information, or anything that happens in connection with your use of the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Pluto Family Calendar for the Service during the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

13. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Pluto Family Calendar and its owners, operators, affiliates, service providers, and licensors from claims, liabilities, damages, losses, and expenses arising out of or related to:

  • Your use or misuse of the Service;
  • Your content;
  • Your violation of these Terms;
  • Your violation of applicable law or the rights of another person.

14. Termination

You may stop using the Service at any time.

Pluto Family Calendar may suspend or terminate your access to the Service, remove or restrict your content, or terminate an account if you violate these Terms, engage in unlawful or abusive activity, or if we otherwise reasonably determine that termination is necessary to protect the Service or its users.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law, will survive termination.

15. Changes to These Terms

We may update these Terms from time to time.

By continuing to use Pluto Family Calendar after updated Terms become effective, you agree to the updated Terms. When you create an account or sign in to the Service, you agree to the Terms then in effect.

We are not required to provide individual notice of changes to these Terms.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be subject to the applicable state or federal courts located in or servingUtah County, Utah, USA, unless applicable law requires otherwise.

17. Severability

If any provision of these Terms is determined to be unenforceable or invalid, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other terms expressly incorporated into the Service, constitute the entire agreement between you and Pluto Family Calendar regarding your use of the Service.
